Please read these Terms of Use ("Terms") carefully before using Rock Identifier ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, do not use the App.
2. Description of Service
Rock Identifier is a mobile application that uses artificial intelligence and machine learning to help users identify rocks, minerals, and gemstones from photographs. The App also allows users to catalog samples, organize collections, track expedition locations, and explore a mineral database.
3. AI Identification Disclaimer
Important: The App's identification results are provided for educational and informational purposes only. AI-based identification is not 100% accurate. You should not rely solely on the App's results for:
- Professional geological assessments or surveys
- Determining the commercial value of minerals or gemstones
- Safety-critical decisions (e.g., identifying potentially hazardous minerals)
- Legal or regulatory compliance purposes
Always consult a qualified geologist or mineralogist for professional identification needs.
4. User Content
You retain ownership of all photos, notes, and data you create within the App ("User Content"). By using cloud-based identification features, you grant us a limited, temporary license to process your photos solely for the purpose of providing identification results. We do not claim ownership of your User Content.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract the source code of the App or its ML models
- Interfere with or disrupt the App's services or servers
- Use automated systems to make excessive API requests
- Redistribute or resell identification results as a commercial service
6. Subscriptions and Purchases
Some features of the App may require a subscription or one-time purchase. All payments are processed through the Apple App Store and are subject to Apple's terms and conditions. Subscription details, including pricing and renewal terms, are displayed before purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage or cancel subscriptions in your Apple ID account settings
- Refund requests must be directed to Apple, as we do not process payments directly
7. Intellectual Property
The App, including its design, code, ML models, mineral database content, graphics, and trademarks, is owned by Rock Identifier and is protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks or branding.
8. iCloud Sync
The App may use Apple iCloud to sync your collection data across your devices. iCloud sync is subject to Apple's iCloud Terms of Service and requires an active iCloud account with sufficient storage. We are not responsible for data loss resulting from iCloud service disruptions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Rock Identifier and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or goodwill
- Inaccurate identification results
- Actions taken based on the App's AI-generated information
- Service interruptions or data loss
Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Warranty Disclaimer
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that identification results will be accurate, complete, or error-free.
11. Indemnification
You agree to indemnify and hold harmless Rock Identifier and its developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
12. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability and Indemnification) will survive.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
